All content included in or made available through freeflyvr.com, such as text, graphics, logos or images is the property of Proteus VR and is protected by UK and international copyright and database right laws.  The compilation of all content included in or made available through freeflyvr.com is the exclusive property of Proteus VR and is protected by UK and international copyright and database right laws. You may not extract and/or re-utilise parts of the content of this website without our written consent.  In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation any substantial parts of the content of this website, without our express written consent.

To provide increased value to you, we may provide links to other websites or resources for you to access at your sole discretion. Such websites are owned and operated by third parties. We do not review or endorse such external sites or resources and are not responsible for the privacy practices or actions of such third parties or the content of such websites.

Conditions of sale

These Conditions of Sale govern the sale of products by Proteus VR to you.

  1. Our contract

Your order is an offer to Proteus VR to buy the product(s) in your order. When you place an order to purchase a product from Proteus VR, we will send you an e-mail confirming receipt of your order and containing the details of your order. This order confirmation e-mail is acknowledgement that we have received your order, and does not confirm acceptance of your offer to buy the product(s) ordered.  We only accept your offer, and conclude the contract of sale for a product ordered by you, when we dispatch the product to you and send e-mail confirmation to you that we’ve dispatched the product to you.

  1. Delivery

Please note that unless otherwise stated on the website, delivery estimates are just that. They are not guaranteed delivery times and should not be relied upon as such. We make every effort to deliver goods within our estimated timescales, however delays occasionally occur due to factors beyond our control. Proteus VR shall be under no liability for any delay or failure to deliver the products within estimated timescales. Risk of loss and damage of products passes to you on the date when the products are delivered or on the date of first attempted delivery by us.

  1. Availability and pricing

All prices are inclusive of VAT at the current UK rate. We cannot guarantee that a product you request is available. In the event that we are unable to supply the product, we will inform you of this as soon as possible and you will not be charged for those products (a full refund will be given where you have already paid for the products). Please note that we are not reliable for any duties or taxes at the country of destination. We ship DAP (Delivered At Place) and not DDP (Delivered Duty Paid), more info here.

 

  1. Payment

We take payment from your card or PayPal account at the time we receive your order, once we have checked your card or PayPal details and stock availability. Additional Terms and Conditions for payments made by paypal can be found at www.paypal.co.uk.

To ensure that your credit, debit, charge card or PayPal account is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered credit reference agency that may keep a record of that information. This is done only to confirm your identity; a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.

While we try and ensure that all prices on this website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

  1. Your Right to Cancel

Under the Consumer Contracts Regulations, you have the right to cancel your order for any item purchased from Proteus VR for a full refund. Order cancellations must be made in writing to us at this address supportinfo@freeflyvr.com, quoting your order number, within fourteen working days of the day after you receive the goods. If however your order has already been processed and dispatched, you will need to return the order to us at your charges and we will not refund shipping costs.

  1. Returns and exchanges

If you are not entirely satisfied with your purchase, we’re here to help.

Returns

You have 14 calendar days to return an item from the date you received it. Please inform us immediately of your intention to return the product.

To be eligible for a return, your item must be unused and in the same condition that you received it. Your item must be in the original packaging and needs to have the receipt or proof of purchase. Also provide us with the tracking code so we check the shipments status.

Please mark your shipment as ‘returned goods’ for customs. Freefly VR hold no responsibility for non-tracked delivery services.

Refunds

Once we receive your item, we will inspect it and notify you that we have received your returned item. If your return is approved, we will initiate a refund to the original method of payment.

You will receive the refund within a certain amount of days, depending on your card issuer’s policies.

Shipping

You will be responsible for paying for your own shipping costs for returning your item.
Shipping costs are nonrefundable.

  1. Limitation of liability

Proteus VR will not be responsible for (i) losses that were not caused by any breach on our part, or (ii) any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure), or (iii) any indirect or consequential losses that were not foreseeable to both you and us when the contract for the sale of products by us to you was formed.

Nothing in these conditions limits or excludes our responsibility for fraudulent representations made by us or for death or personal injury caused by our negligence or wilful misconduct.

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause beyond our reasonable control.  This condition does not affect your right to have the products sent to you within a reasonable time.  If the delay occurs before the products are dispatched, we will not charge you for the products until they are dispatched and you may cancel your order at any time prior to dispatch.

We reserve the right to make changes to our website, policies, and terms and conditions, including these Conditions of Sale at any time.  You will be subject to the terms and conditions, policies and Conditions of Sale in force at the time that you order products from us, unless any change to those terms and conditions, policies or these Conditions of Sale is required to be made by law or government authority (in which case it may apply to orders previously placed by you).  If any of these Conditions of Sale is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

  1. Are you under 18?

We sell to adults. If you are under 18 you may only use this website with the involvement of a parent or guardian.

  1. Waiver

If you breach these Conditions of Sale and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Conditions of Sale.
